Agreement to Terms

By accessing or using the services of Clearstone Somerville Concrete, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

Clearstone Somerville Concrete provides concrete construction services including but not limited to driveway installation and repair, patios, walkways, sidewalks, foundations, slabs, footings, retaining walls, concrete repair, resurfacing, leveling, stamped and decorative concrete, concrete cutting, removal, replacement, parking lots, curbs, and commercial flatwork.

Estimates and Quotes

All estimates and quotes provided are based on the information available at the time of inspection. Estimates are valid for 30 days from the date of issue. Final pricing may be adjusted if site conditions differ from initial assessment or if additional work is required. We reserve the right to refuse service to anyone for any reason at any time.

Payment Terms

Payment terms will be specified in your service agreement. Typical payment schedules include a deposit upon contract signing, progress payments during the project, and final payment upon completion. We accept cash, check, and major credit cards. Late payments may be subject to interest charges as permitted by law.

Project Timeline

Project timelines are estimates and may be affected by weather conditions, material availability, site conditions, or other factors beyond our control. We will make reasonable efforts to complete projects within the estimated timeframe and will communicate any delays promptly.

Permits and Regulations

Unless otherwise specified in your service agreement, obtaining necessary permits is the responsibility of the property owner. We will work with you to ensure all work complies with local building codes and regulations. Additional fees may apply for permit acquisition services.

Warranty

We stand behind the quality of our work. Warranty terms will be specified in your service agreement and typically cover defects in workmanship for a specified period. Warranties do not cover damage caused by improper use, lack of maintenance, natural disasters, or normal wear and tear. Concrete may develop minor surface cracks due to natural settling and weather conditions, which are not covered under warranty.

Property Access and Site Conditions

The property owner is responsible for providing clear access to the work area and ensuring utilities are marked before work begins. We are not responsible for damage to unmarked underground utilities. The property owner must remove or protect any items that could be damaged during construction.

Changes to Work

Any changes to the agreed-upon scope of work must be approved in writing and may result in additional charges. We will provide a written change order detailing the modifications and any associated costs before proceeding with changed work.

Cancellation Policy

Cancellations must be made in writing. Deposits may be non-refundable if materials have been ordered or work has commenced. Cancellation fees may apply as specified in your service agreement.

Limitation of Liability

Our liability is limited to the cost of the services provided. We are not liable for indirect, incidental, or consequential damages. We maintain appropriate insurance coverage for our operations.

Dispute Resolution

Any disputes arising from our services will be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with Massachusetts law.

Intellectual Property

All designs, plans, and materials created by Clearstone Somerville Concrete remain our intellectual property unless otherwise agreed in writing.

Privacy

We respect your privacy and handle your personal information in accordance with our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.

Severability
